  55. Some weeks it's thin, some it's not. An un-thin week. We seem to have
  56. a contentious thread heading down a far too familiar path (which will
  57. remind me to complete this week the changes I proposed for ARTSPEC.DOC
  58. this past summer, dealing with "controversial articles"...)
  59.  
  60. Speaking of ARTSPEC.DOC -- *NOT ONE SINGLE ARTICLE* this issue was in
  61. anything close to correct format. Problems: missing titles; on was
  62. ZIPped; IBM character set; .TXT filename; not CR/LF line terminated;
  63. too-long lines; funny formatting.
  64.  
  65. Lucky for you I'm not a stickler for rules, and I'm generous with my
  66. time.
  67.  
  68. With the ARTSPEC.DOC revision (considerably shorter) I'll be running a
  69. condensed (< 20 lines) version every FidoNews. Maybe that will help.
  70. Maybe I should bill the authors for my time.

  73. The bulk of this issue is devoted to two articles relating to U.S.
  74. telecomm. law, and obviously does pertain to FidoNet. This might be a
  75. good time however to remind authors and potential authors that "your
  76. own zone" is not the whole enchilada, and even Zone 1 is only 64% of
  77. the nodelist.
  78.  
  79. While the nitty details of U.S. law probably aren't of much interest
  80. to non-U.S. FidoNet members (well, maybe Canadians & Mexicans cuz they
  81. so often get splashed by what misses the pot excuuuuse the imagery), a
  82. brief synopsis or background info for non-US-ers would go along way to
  83. explaining the context not only to our neighbors, but domestic readers
  84. as well; the sense of perspective never hurts. I frequently forget
  85. when writing detailed techy stuff that not everyone shares my detailed
  86. point of view, and in fact, that's exactly who I want to read it!

  89. articles cuz it's not. On with the news...

  101. Opposing the Telecommunications Act of 1991

  112. This article is concerning a bill brought before the Congress of
  113. the United States.  People outside the United States need not be
  114. concerned about this bill... unless, of course, American politics
  115. interest you.  :-)

  118. WHAT'S THE STORY?
  119. -----------------

  121. On October 8, 1991, a bill was brought before Congress which, if
  122. passed, will prevent the Bell companies and other local phone
  123. service carriers from monopolizing the information services.
  124. This is a well-intentioned bill, and it has potential.  However,
  125. it was apparently written by ill-informed lawmakers.  It does not
  126. address the needs of BBSs.  Whoever wrote this bill apparently
  127. didn't even know that we exist, or else simply doesn't even begin
  128. to understand the issues.
  129.

  132.    If this bill is passed in its present form, the Bell companies
  133.    will be free to charge BBSs whatever rates they see fit.

  138. HOW CAN THEY GET AWAY WITH THIS?
  139. --------------------------------
  140.  
  141. Section 201A(b)(1) of this bill's proposed ammendment to the
  142. Communications Act of 1934 states that...
  143.  
  144.    "Each local exchange carrier   [ that is, local telephone
  145.    service provider ]   shall provide interconnection, on a
  146.    reasonable and nondiscriminatory basis, to common carriers and

  150.    other providers of telecommunications services and information
  151.    services who request it."
  152.  
  153. The phrase "on a reasonable and nondiscriminatory basis" is very
  154. vague.  The word "reasonable" can mean a lot of things.  What is
  155. clear is the word "nondiscriminatory."  This means two things:
  156.  
  157.    1. The phone company cannot charge a competing information
  158.       service a higher rate than it charges its own information
  159.       service subsidiary.  This is good.
  160.  
  161.    2. The phone company cannot charge different rates to
  162.       different information services.  Since a BBS is an
  163.       information service, it must be charged the same rates as a
  164.       for-profit service.  This is not good.
  165.  
  166. Section 201A(e) of this bill's proposed ammendment to the
  167. Communications Act of 1934 states that...
  168.  
  169.    "A local exchange carrier shall prepare and file tariffs in
  170.    accordance with this Act with respect to the interconnection
  171.    and network access services required under this section.  The
  172.    costs that a local exchange carrier incurs in providing such
  173.    services shall be borne solely by the users of the features
  174.    and functions comprising such services."
  175.  
  176. What this basically means is that the phone company may add a
  177. surcharge onto the standard phone rate, to cover whatever costs
  178. it can dream up.  Our government's regulatory commissions do not
  179. have a good track record as far as verifying the validity of such
  180. costs.  Remember that we are already placed in the position of
  181. having to pay business rates by the "nondiscriminatory" clause.
  182. This section places on us the added burden of what would
  183. effectively be modem surcharges.
  184.

  186. WHAT CAN WE DO?
  187. ---------------
  188.  
  189. Write to your congressmen!  Let them know that you are opposed to
  190. this bill in its present form.  Let them know that if a section
  191. is added which guarantees that free BBSs will only be charged
  192. residential rates, then and only then you will support the bill.
  193.  
  194. Be sure to tell your congressmen that the bill you are opposing
  195. is House bill HR 3515.  The following points should also be
  196. brought up in your letter:
  197.  
  198.    1.  BBSs are not-for-profit.
  199.  
  200.    2.  BBSs are not typically used as heavily as larger,

  204.        for-profit information services.
  205.  
  206.    3.  BBS operators do not typically charge money for use of the
  207.        system.

  209.    4.  The section of the proposed bill which concerns us is
  210.        (quote this exactly):

  212.           section 201A(e) of this bill's proposed ammendment to
  213.           the Communications Act of 1934
  214.  
  215.    5.  In the state of Texas, Southwester Bell Telephone
  216.        attempted to charge business rates to all BBSs, and the
  217.        Texas Public Utilities Commission unanimously agreed that
  218.        this was unfair.  In your letter, refer to Texas PUC
  219.        docket 8387, Reginald A. Hirsch, et. al. vs Southwestern
  220.        Bell Telephone Company.

  252. Southwestern Bell Telephone's attempt to impose business rates on BBSs
  253. operating from people's homes and the RBOCs' interest in selling
  254. information services is no coincidence!  The roots of this issue go
  255. far deeper than the desire to eliminate competition for information
  256. consumers' dollars.

  261. What is happening is a fundamental conflict between an old structure
  262. of power centralized in the hands of the few (SWBT, MO PSC, and so on)
  263. with an emerging, new structure of power (knowledge) decentralized and
  264. distributed throughout the whole.  There is a major transformation
  265. taking place in our society, and the old power brokers don't want to
  266. let go of their privileges.
  267.  
  268. To control the flow of information is to control people's minds.  To
  269. liberate the flow of information is to liberate people's minds.  The
  270. latter is the path to true wealth.
  271.  
  272. The Greater Kansas City Sysops Association is currently mobilizing a
  273. campaign to block SWBT's proposed change in tariff.  The GKCSA
  274. campaign is needed to deal with the immediate threat to hobbyist BBSs.
  275. Perhaps an additional, more radical, effort is needed to deal with
  276. the roots of the issue.
  277.  
  278. A special supplement with the Dec. 2 issue of Telephony contains a
  279. number of articles on the topic "Building the Infrastructure".  One
  280. article states that a number of the Bells have issued requests for
  281. proposals for fiber in the local loop.  BellSouth is studying responses
  282. to its RFP, and hopes to pick vendors this year.  Bell Atlantic is
  283. looking at the first half of next year for vendor contracts.
  284.  
  285. Who is going to pay for these upgrades to the network?  We, the
  286. ratepayers, will.  Not only will we pay for the upgrades, we'll also
  287. be paying for the fatcat salaries of management (who make decisions
  288. about changing tariffs on BBSs), and for the profit that goes into
  289. the pockets of the stockholders.
  290.  
  291. Southwestern Bell's 1990 Annual Report states that total stockholder
  292. equity is $8.5 billion.  With a net income of $1.1 billion, in less
  293. than 8 years we, the ratepayers, will have given the stockholders
  294. more than they put into it.
  295.  
  296. It does not make sense to me that we continue in this fashion.  I
  297. would like to see the users design the network, and make the pledges
  298. and payments to the vendors and the craftspeople to cover the costs of
  299. implementing a public, multi-media, fiber optic network.
  300.  
  301. Bills have been introduced in Congress calling for ubiquitous
  302. broadband telecommunications capabilities by the year 2015.  If we
  303. put our minds to it, we could have it in place through direct citizen
  304. action by the year 2000.

  316. In 1987, I was stationed in Schweinfurt, West Germany as a Tank Gunner
  317. in the 3d Battalion, 64th Armor Regiment, 3rd Infantry Division.  While
  318. I was there, I became close friends with a fellow by the name of Mike
  319. Lang.  Mike and I spent the next few years enjoying Europe, while at
  320. the same time, helping each other along as we counted down the days
  321. until
  322. we got out!  Well, I left about 6 months before Mike did, and after a
  323. while
  324. we lost contact with one another.
  325.  
  326. In December of this year (1991), I decided that I would try and locate
  327. him
  328. after nearly 2 1/2 years of no contact.  The only thing I had to go by
  329. was
  330. the address where he lived prior to joining the Army, in Milford, CT.
  331. I tried calling information.  Nothing.  So, I said, what the hell?? I
  332. yanked out the latest copy of the nodelist and searched for Milford.
  333. Sure enough, Fido was there.  I netmailed a guy by the name of Phil
  334. Palumbo,

  357. Within 24 hours of my netmail transmission to Phil, my phone rang!  It

  359. Mike, my old buddy.  Phil netmailed me later and informed me that he
  360. tried
  361. information, as well, and also attempted to use the phonebook to locate
  362. him.  After all else had failed, he hopped in the car and DROVE to the
  363. address that I had given.  Turns out that Mike still lived there!

  381. On my system there exists the need to allow Users to perform File
  382. Requests from other FidoNet systems that are local to my system. I
  383. also need to allow Users to perform File Requests from systems
  384. that have 'education' as their primary reason for existence. This
  385. would remove the burden of forgetting to request files that Users
  386. ask me to get for them and makes the task of supplying my Users
  387. with educational and informational files just that much easier.
  388.  
  389. There is also the need to have several forms of security so that
  390. the FidoNet systems that are called are limited to those systems
  391. that I wish to pay for in phone costs. I may also like to lock-out
  392. some Users who abuse the privileges, of course.
  393.  
  394. The project REQUEST.LZH is a DOOR program that does everything I
  395. need, and has worked well with Remote Access. It is available on
  396. my system for File Request and 'human download' and comes with
  397. the source code (one C file) as well as an on-line help file for
  398. the Users.
  399.  
  400. Come to think of it, it employs an inactivity time-out so that if
  401. a User walks away from its modem, Request will exit, returning
  402. control back to Remote Access. Also, if Data Carrier Detect is
  403. dropped, Request will return control to Remote Access which will
  404. exit and hand control off to Front Door.
  405.  
  406. The Remote Access system I am playing with has a new menu entry
  407. that preforms a 'type 7' execute to the Request program which
  408. validates the User and allows him or her to make as many File
  409. Requests as is permitted by their security allowances (which are
  410. defined in the configuration file). Technically, the program builds
  411. *.MSG Fido type FileRequest packets in the systems Network Mail
  412. directory, marking them as Immediate using the normal FLAG Kludge
  413. line.
  414.  
  415. When the Remote Access system returns control to the Front Door
  416. project, Front Door likes to scan the Network Mail folder for any
  417. messages entered locally that are marked as 'Immediate' and it
  418. finds the Users request packets and Front Door takes it from that
  419. point.

  421. I have a Files Directory which offers file listings of the systems
  422. that my Users are allowed to call. Indeed, the on-line help file
  423. describes where to find these file listings. When User-requested
  424. files are received, I still like to look them over before I move
  425. them to the Files Directory called 'User Requested Files' just
  426. so that my ass is fairly well protected if they do something that's
  427. unusually stupid. And of course a log file is maintained so that

  490. Frederic L. Rice (1:102/901.9) wrote an article, "Cleaning out the dog
  491. house," in which he alerted sysops to two categories of legally
  492. problematic BBS content, pirated software and "obscene" graphics,
  493. giving the advice that sysops should be vigilant against pirated
  494. files, and should be careful that access to "adult" files is limited
  495. to adults.
  496.  
  497. I should note, however, that there is a third category of material
  498. which can pose legal trouble for a sysop.  This is libelous text,
  499. material that defames a person.  Somebody who writes material of this
  500. nature, and a sysop who allows his system to be used in the
  501. dissemination of such things, could be the subject of a lawsuit in
  502. today's litigious climate.
  503.  
  504. Unfortunately, a possible example of such conduct has been provided to
  505. the FidoNews audience in the form of Billy Cash's (1:226/70.0)
  506. response to Rice.
  507.  
  508. Cash, for no obvious reason, flies off the handle in opposition to
  509. Rice's quite reasonable article.  He says:
  510.  
  511.    "I think the blame the bad name bulletin board services have
  512.     lies squarely on the shoulders of people like Mr. Rice."
  513.  
  514. Later, he adds:
  515.  
  516.    "Yes, I think I would help move heaven and earth to remove
  517.     Mr. Rice."
  518.  
  519. These are quite extreme character judgments to be making of another
  520. sysop as a result of one article.  I don't know Mr. Rice, but if I
  521. were he, I would be heavily offended by Mr. Cash's article.  Now,
  522. given my own pro-free-speech philosophy, I would not be likely to turn
  523. such offense into a lawsuit (I think that even the most offensive
  524. speech should not be forcibly suppressed), but if I were of a more
  525. statist bent, I could see how I might justify using the court system
  526. to avenge such a scurrilous and gratuitous attack on my character.
  527. Hence, the dissemination of remarks of Cash's sort pose as much of a
  528. threat of dragging BBSs into the legal system as do any nude GIFs.
  529.  
  530. Since I'm not a lawyer, I can't really state for sure whether Cash's
  531. remarks are actionable as libel.  However, I would think they at least
  532. violate the Fidonet rule against "excessively annoying behavior."
  533. We're all sysops together, and publicly airing statements to the
  534. effect that somebody else is a bad sysop and should be forcibly
  535. removed is something not to be done lightly, and not to be easily
  536. condoned if done without very good reason (e.g., actual evidence of
  537. lawbreaking on the part of the target sysop, not just a disagreement
  538. of opinion stemming from a FidoNews article).  Mr. Rice might have a
  539. very good case for a FidoNet policy complaint against Mr. Cash, if he
  540. chooses to pursue it.

  545. In conclusion:  Children, behave.  All the endless bickering that has
  546. plagued FidoNet for years is bad enough, but it becomes even worse
  547. when it reaches the level of "debaters" feeling they can make complete
  548. judgments as to the moral character of another sysop merely on the
  549. basis of a single article.  Debate and disagreement, even of a highly
  550. vigorous nature, can be healthy, as it helps to examine all viewpoints
  551. and options.  Personal attacks, threats, and insinuations regarding
  552. the moral depravity of all who disagree, are not healthy, and tend to
  553. suppress rather than enhance constructive discussion about the future
  554. of the computerized communication medium.

  563. I've been playing PBM games for nearly a year now, and it has been
  564. a very enjoyable experience for me.  About three months into playing
  565. my first game (Spiral Arm by Graff Simulations) I began wondering
  566. if there was anyone in FidoNet who was also in my game.  I placed
  567. a general announcement in the bulletin section of my game, notifying
  568. people of my node number, but no mail has come.  So I let it rest,
  569. until now.
  570.  
  571. PBM games are games that lend themselves well to a network.  Graff
  572. Simulations even supports turn submission through Compuserve.  I once
  573. again began to think about how many players there should be in a
  574. network of over 14,000 nodes.  So I decided to act.
  575.  
  576. I have hearby started up the PBM echo, which is dedicated to bring
  577. Play-By-Mail gamers together in a forum.  In this echo I hope to expose
  578. others to PBM games, review the various companies and games out there,
  579. and possibly even serve as a link for diplomacy for certain games.

  638. 1. The INTRUDER conference is for the purpose of detecting,
  639. identifying, and eliminating the intrusion of non-hams onto ham
  640. bands.

  642. 2. Since not all non-ham signals in the ham bands are of illegal
  643. origin, great care must be taken in identifying them, tracking
  644. their location, and gathering evidence to be used in the
  645. prosecution of those transmitting them.

  647. 3. The INTRUDER conference is designed also to exchange
  648. information on tracking hardware and coordination of its use in
  649. both drills and actual intruder tracking.

  651. 4. When security requires it, messages may be encrypted. The
  652. moderator shall be supplied with all deciphering programs and
  653. keys before their use commences. Such means shall be employed
  654. only if plain language would tip off a suspect that he is being
  655. tracked.
